I`ve seen the same person appear as a litigant twice.

No, they use real people in the case. What the process is is the producers go down and look through the actually filed cases in small claims court. If the case seems interesting with good issues, they contact the litigants, interview them, and if they like the people, (as in should make good television), they get the people to dismiss the case and agree to binding arbitration, which is really what those court shows are. The part that gets people to go on the show is that there is a money pool for the case of up to $5000, the maximum amount allowed in those cases.
If you are the winner, and you are awarded your damages out of the pool, and whatever is left is split 50-50. So, even if you lose, you win.
