I mean I was in the hospital for 2 days since thursday. Then like I thought it only takes a few hrs for the blood resault to come back in. So, why didnt they just wait and arrest me when i get out the hospitail for driving drunk?

in my country you would have been charged with drink driving within a few hours & given a date to go to the judge defend it

As you went to the hospital and were disabled, it could take several months for the paperwork to be processed; 5-6 months later (enough time to make sure that you will be able to be able to use the excuse of being too disabled to appear in Court) to get an arrest warrant issued if a client was hospitalized is not unusual.

If you want to expediate the process, hire an attorney now.

You will have to go through being arrested and processed but a good attorney can arrange for the optimal time for you to surrender yourself (usually when the fingerprint agent is available) so you can arrange bond ahead of time with a bailbondsman and spend a minimal amount of time in jail (2-4 hrs).

You will still have to go through appearing in Court for Arraignment, but your attorney can then work out a Plea Agreement with the Prosecutor, which you would need agree to (and adhere to as part of your probation) the final Hearing.

Confusing question. The fact that you were in the hospital (not sure if it was DUI related) may be why. You normally get arrested on a DUI and placed in jail for a long enough period of time to sober up. You are then released and given a court date.
