Neighbor damages siding on my house by throwing a piece of rebar at it in anger of me putting up a fence on the property lines and police say it's not good enough to pursue, won't even type a report about it? Have witness to prove what happened but police said because we didn't see where exactly it hit the house, not good enough? Already took pictures but police didn't care?

The damage was not minute it penatrated thorugh the siding and part of the walling. Have had problems with him over everything you could think of when having a neighbor. He has screamed profanities at me since the day I closed on the house. I have done everything through the legal system as far as permits and remoedeling protocols. Have tried to talk to him but he is a very aggressive person, and does not take legalities as an ending result.

You really haven't asked a question, you're just stating an occurrence. What you have described is Criminal Damage to Property. The Police don't see the damage, and you say it is there. At this point, you should go into the Police station with your evidence, and talk to someone in charge.

This is more a civil matter rather than a criminal matter. It seems that you have suffered "damages" based on the action of your neighbor. You could take this to a Small Claims Court (usually limited to a specific dollar amount - varies from state to state) and get a judgement against your neighbor. Got to consider how you will prove your accusation. Goof luck.

if knowone seen the guy cause the damage then there is nothing the police can. it has nothing to do with not caring,it is the law.your next step would be to take the case to the da's officer. they will not take the case unless you have a witness.even with a witness they more than likely will not take the case.what you have left is a civil case where you sue the guy for damages. if you have no wirness they will throw the case out.you can not say the police do not care/they have to have proof and you do not have that.

You need to try and "file" a police report again. If that doesn't work, then call your insurance company right away. You will have to furnish them with date, the information about the neighbor, the approximate place where the accident was inflicted and even your "attempt" to have the initial police report filed. Could be both an insurance and a small claims court matter.

I feel for you, I had a guy throw a huge hunting knife at me on the freeway, it hit below the window and punched a hole in the driver side door. The California Highway patrol refused to come out to take a report or to do anything. I gave them the plate number but they were too busy to do anything about it.

Try taking it up through your house insurance - maybe if they have to pay for damage to your home, they'll pursue it against your neighbor. Just an idea...

How much damage could possibly have been done? Probably not enough to justify the tax dollars that would be wasted on bringing police into it. Grow up.

Take it to an insurance adjuster and see if hee can 'see' the damage, then take his findings to the police and lay your charges with the evidence provided.

If the police don't feel it's a criminal action, you could choose to pursue civil action.
