you can sue, but remember, in order to win and collect anything, you have to PROVE DAMAGES. What are your PROVEABLE damages? Was your identity stolen ? Anybody misuse a credit card of yours or get money from your bank account? They do this notification to alert you to the POSSIBILITY that something improper could happen, but even with that event, it is UN-likely you will win in court. The defense they will raise is that they exercised REASONABLE care to protect your information. Not all crime is preventable.
