Is it legal to suspend a student from public school for something that didn't happen AT school?

this is my district's procedure: http://district279.org/who/polpro/policy514.cfm

It says that it is in affect "...at any time or any place..." directly in the policy, but is it legal for their jurisdiction to be that far?

Also, the incident at hand was partially created at school, however the act in itself wasn't bullying.
A student took a video of another student and put it on youtube. The student who was video'd found the video on youtube, and now the video-taker is suspended. Is this a fair move by the district?

The school has a duty to protect the safety and the dignity of students. They can be sued, for millions, if they fail in that duty.

For my part, I care a lot more about the right of a kid not to be bullied than about the rights of a bully.

What would your postion be, if a bully hassled a kid from school at a shopping mall on a Saturday afternoon?

The point is that the hassled kid would not feel safe or comfortable coming to school. The district is in the business of educating kids, not making sure that the rights of bullies are protected by technicalities.

Yes, schools can do that and yet I can't give you a legal reason why. For example, if a guy rapes a girl at a party and goes back to school on Monday, he could get the boot from school over that. Yet again, I don't know the legal reasons why. I just know this is legal.

It has extra to do with the State regulations on Cyber bullying and the place the regulations are headed on your State. the bigger question is how ought to you probably be one in all those numb nuts to submit something because of the fact the regulation has handed that employers can decide directly to no longer hire you in accordance with what you submit publicly. you are the single that has no properly suited nor do I to annoy somebody and then go on line and harass them extra. save you eye out for the regulations of your State. There are going to be some enormous judgements interior here few years approximately this in each State. some have already made it regulation.

Fair? I'd have to say yes. Going to public school is a privilege, not a right. The school has every right to protect its students from bullies or other dangerous people.

Where was the video taken? In school? If taken at an outside public place, it is fair for publication.

Public school is a state-run business...they have little legal weight but can impose suspension or expulsion if they don't get their own way...

in my school, you can get suspended for doing something outside of school like fighting or posting videos such as your example if they find out...so i guess they are allowed to do that...
