Ex tenant left property owing £1500 in rent and interest. I took them to small claims and won. Judge said that from date of application no more interest but £50/month should be paid to be in my account by end of each month. After first payment it has been constantly late - from arriving nearly two months late (sent bailiffs in ) to usually arriving the first or second of the following month. Each time he pays before bailiffs can work. What else can I do as I am being charged by bank £25 x 2 on my outgoings on 1st of each month and have had to borrow at 28% to cover what he owes. Can i send in bailiffs for more than the 1 x £50 payment and can I get him to pay some of my bank charges?

If I go for an attachment of earnings can I ask for more than £50 as he originally offered to pay £100?

The answer is simple, but you may not like it.

You can only send in the bailiffs to collect the sum outstanding. An alternative would be to let him run up a bigger debt and return to court to ask that interest on the judgement debt under the judgement Act be applied because of persistent default.

As to the second part of the question, no you can't (claim bank charges off him). You have no casue of action.
The reason you are overdrawn is because you do not have enough cash in your account. Whatever else the toerag ex-tenant may be responsible for, it is not for the amount of money you keep in your bank account.

Can you go back to Court and apply for an Attachment of earnings Order??
