My sister and I are trying to find out if we have any legal rights to my fathers property? He died 2002 and left the property to our step mum! She has married grown up children like ourselves. There is no will, as far as we know! We would like to know if legally as his children we have any rights, if and when she dies! Any help would be really appreciated. Regards

hey im not sure whats it like where you live but where i live the wife gets a certain percentage and the kids do too(i dont know the exact number,sorry) so in your case your stepmom could keep the house but she would have to pay out to all kids after the value of the house has been figured out.

You say he 'left the property to your step mum' but then you say there is no will?

Assuming you live in England, if they owned the property jointly as joint tenants then I'm afraid the house now belongs to her and there's nothing you can do

Do you get on with your Step Mum? if so talk to her about this dreaded question if she's a nice person I'm sure she will answer this for you if not then the citizen advise station will answer this for you.

No once the property passed to your step mum it became hers to do with as she wants.
Search intestate at www.direct.gov.uk
