My daughter is 16 as of 3/6/91 and her boyfriend (who lied and said he was 1 yr older than her) turned out to be 20 as of 9/26/07. We never liked the "hood rat" since day 1 but knew that as teens the more you keep them away, the more they want. She's 2 yrs behind in school due to truancy skipping high school to go to Newark, NJ projects to be with him. 3 weeks ago, told us she's pregnant (confirmed it next day took her to our doctor) and he's the dad. She's determined to keep the baby, and we're determined to see whatever remedy under the Law we have to prosecute. Most likely able to get ahold of IM's (we keep chat logs unknown to them) and email showing they had a sexual relationship when she was only 15(since NJ's AOC is 16). If not statutory rape is here, can we at minimum charge "contributing to the delinquency of a minor". We've got to do something, we've tried for the past 2 yrs to keep him away but we see what that did.

Are all of your kids problems really this guys fault. Your daughters life is a mess and all you can do is blame someone else instead of taking responsibility. yeah...hes a piece of **** but come on. This is gonna end bad for her if you don't pull it together.

Bro, first of all I want to apologize for every hate comment you've gotten on this question. Second of all, I'll try to answer your question: It is NOT illegal to hug/kiss someone! As long as it's just a kiss on the cheeks, or on the lips kissing is okay. (so french-kissing is out of the question!) And if you REALLY love him/her, and you are able to wait, don't rush things. Just go nice and slow... There is no need to rush a relationship, even if you differ 5 years. Heck, my parents have an age difference of 7 years! The REAL reason why people are giving these kinds of comments if because the other person is 15. I bet that if you were 25 and the person you dated was 18, they wouldn't have any problem! So anyways, age doesn't really matter, it's LOVE that matters! As long as you two do nothing out of bound, you should be able to have a normal relationship! (But, just to be sure, ALWAYS talk to the parents!)

If you have proof that he had sex with your daughter before she was 16, call the police. It is "Statutary Rape" in the US and he will get a heavy sentence. Whilst he is in prison, you will have the chance to help your daughter to catch up with her education and hopefully sort out her life. However, her options are now limited due to the baby. She is going to need a lot of support so make sure she is aware that you are there for her and you must explain the reasons why what he has done is wrong and why he should be punished. If you don't explain the reasons for having him prosecuted, she will try to protect him and will lie to the police. However, what you musn't do is nag at her or try to pressurise her as that will only bring about her resenting you. You have to make sure that she understands that he is 100% to blame for what has happened and that it's not her fault. It may be wise to have a third party involved such as a counselor or maybe a female police officer to help her to understand.

I am sure if you attempt to prosecute this man it you will only push your daughter further away from you. Obviously, something at home is not right. You mention she is 2 years behind in school. Talking from experience, when a young teen runs off to be with a guy its because she is looking for the love and attention she is not getting at home. What good is it going to do for her or the baby by sending him off to jail??? The baby is innocent and deserves to have a father. Deal with the situation don't react in anger. Love your daughter and child. She is a mother now. She needs support from you.

If she was (and can be proven) to have been sexually active with the boy BEFORE her 16th birthday, then you have cause to file sexual assault charges. Otherwise, you have no case in New Jersey.

New Jersey Statutes
N.J.S. 2C:14-2. Sexual assault

By the way: After rereading the statute you don't have a case, even if they were sexually active before her 16th birthday. From the dates you provided, the boy is less than 4 years older than she and email is not proof of a sexual relationship.

It is hearsay.

And for clarity, New Jersey has no such "Statutory Rape" charge in the statutes. It's either sexual assault or aggrivated sexual assault.

Age of consent doesn't mean that an adult can have sex with a minor. Have you called the police? I'm pretty sure all you need is a DNA test to prove he's the father and he can be charged with statutory rape.

Honestly, you should have done this before the pregnancy, right? But its too late for hindsight.

Yeah, contact the police. You've got good evidence. See what they're willing to go forward with.

Then, pick up and move south. Newark isn't going to help you keep her straight, that's for sure.

call the police. I live in Jersey, you can have the sob arrested for rape and sexual misconduct with a minor.

Yeah, put your future grandchild's dad in jail, that's a great idea.

Why don't you just drop it and work on getting him to support the kid instead?
