The real question is should they. Of course the answer is no. The children deserve both of their parents. However in most states if the couple has joint custody, then no. A lawyer can file with the court to stop the moving parent.

No, not especially during or after without direct written permission from the courts or the other spouse. You will need to devise a plan showing the move would be in the best interest of the children and how youre covering the non custodials visitation rights. Without written permission you can be charged with the Federal felony charge of parental kidnapping so stay on the side of the law and do it right or your kids could end up with your spouse and you in jail

You will have to file papers with the courts to do so and if your ex objects, the courts will most likely tell you no.
Unless your spouse is abusive, you really have no right to do this anyway. Just because the two of you don't get along does not mean your children should be deprived of one of their parents. And, would you want your ex to do this to you? Please give this some serious thought for the sake of the kids.

Not without your spouse's consent, and not without court approval either. If you do this without court approval, it is kidnapping in the eyes of the law.
