Spousal privilege must not violated, otherwise, the evidence is inadmissible. Spouses has the privilege that nothing can be extracted from them without the consent from each other according the the Rules of Evidence.

Question doesn't make sense. If a spouse has evidence, why is the other spouse doing the investigation? It's a conflict of interest.

If you're talking about seeking an opinion from a spouse regarding a case, then one opinion is about as worthwhile as another.
