I live in California and we have these neighbors that some ofmy neighbors and I can't stand. At first it was just a couple and their baby. Recently they rented a room and my landlord doesn't know about it yet. These neighbors are loud, rude, and dirty. They throw their trash out of the window and are very destructive with blinds, screens, floors everything. That aside they smoke and throw their butts out on our courtyard and recently I've had to sweep ashes from our laundry rooms. The worst thing is that we have keys to the main entrance that say DO NOT DUPLICATE and we only gave 2 copies for each apartment and we know they have at least 4. What can we do and how do we do it?

California landlords owe their tenants the "right of quiet enjoyment". That means they must control other tenants who are breaking the law, breaking the rules, or are loud nuisances in general.

Tell your landlord your concerns. Document them in a certified letter to your landlord. If nothing changes, you will need to look for another place. If that means you are leaving before your lease is up and your landlord wants to collect from you for the full lease, you can defend yourself and get out of the lease on the grounds that your landlord breached his obligation to provide "quiet enjoyment".

You'll have to go through the landlord. If this is an entire complex, the management really won't want these people there. They often act too busy to do something, but they'll eventually act upon it if you complain everyday (though, find something new and VALID to complain about. Make sure they are definitively harassing you/making your living experience uncomfortable, being noisy, etc.)

Do not make demand of your landlord, that will only serve to alienates he and make him unsympathetic to your complaint. Let him know what is going on, especially with regard to property destruction and unsanitary behavior. As far as extra tenants they might have made a deal with the landlord and are paying him more rent.

Going through the landlord is about it. He may not allow the extra tenants in the apartment. This is usually covered in the lease or rental agreement.

Complain to the landlord and ask that he take action. I feel your pain, it's annoying when you're doing what's right and your neighbor is just a pig.
