Neighbors decided to complain after we approached them and they were ok with it. We have spent thousands of dollars and are now ready to open in 1 month. I have quit my job in order to get ready for this.

If you are inside city limits then there are zoning codes that dictate where residential, retail business, commercial business, and other types of business can be located. Even if it is your property the city determines what can be build and where.

Before you build anything (but especially a business) you need to obtain a building permit from the city. When you do this the city will check to see if the type of building that you want to construct is allowed at the location you wish to build it. If you live on this property it is most likely zoned "R" for residential, but there are single-family homes built in commerical zones - so don't worry, you might be ok.

CHECK WITH THE CITY to find out what zone you are in. If you are in a Residential Only zone then just one complaint by anyone (not necessaryily a neighbor) will shut your business down immediately.

If you are not in a zone that allows for businesses then you must go to the city zoning committee and petition them to rezone your property. If approved your petition will eventually go before the city council who will then vote (and hopefully approve) the rezoning and you can open for business.

Warning, these zoning laws also apply to home-based businesses. So, just saying that this new building is part of your home and then opporating a business out of it can also get you in trouble if you don't have the right permits.

If you are outside of the city limits then all is fair game (unless you are near power lines or radio towers but that's another story.)

You need to check local zoning laws. Since you live on the property, it may be OK with local officials. Many municipalities will allow you to have a home business. Your neighbors could get a petition to prevent you from opening. I hope that you check local ordinances concerning this before spending so much money. Perhaps your neighbors are concerned with additional traffic. I would talk with them to see if you can address their concerns. Check local ordinances and laws concerning your type of business. I retail business in a residential area is often not allowed. If it is a service business, then you may be safe.

did you get proper permits? what is your neighborhood zoned for? go to the city or county administrators and ask what can be done, if anything. if you can legally keep the business, maybe the neighbors will calm down when they see the business won't disrupt the area.

if you generate any traffic to your business and it is in a residential area you will shut down unless it zoned commercial. If no traffic(I mean people coming to your door) such as mail order or Internet than they have no say in the matter
