I live in Iowa. I sold a car and a stove for $250. She paid me with a check that I deposited into my bank the following Monday. (She paid me on Saturday) It took nearly 2 weeks for the check to come back to my account as a Charge-Back - reason NSF. I called my bank for advice. I then took their advice and called HER bank to see if I could bring the check in to cash. No luck, not enough funds in her account.
After she finally returned my calls later that day, she told me that she would come to my house immediately following work on Friday (her payday) and pay me the cash. I know that Iowa law provides that you can recover up to 300% of the check amount, but under what circumstances? Should I just take the check to the police station? Or to the County Attorney? Will I be able to recover my property and the money? Or just either/or?
Any advice is GREATLY appreciated!
