I used to have a reasonably good job and had a salary close to 100K during my divorce. I lost my job 6 months after the divorce and I have to pay child support of $850. She "agreed" in changing CS to $ 550 (we have 50% custody of 1 daughter 5yo). In the last 4 months (while I job hunt and work part time) I have been making less than her. What should I do? I know I should find an ok job in 3 or 4 months but it just makes me crazy to have to pay CS+insurance and make less than her. Do you have any recommendations? Thank you!

You can appeal directly to the CS office, but I would send a short 'request for a hearing' based on your circumstances and make sure you pay the 5 bux for the certified letter and the return reciept. The CS office has a bad habit of dumping on the husband. Then you can explain your situation to the court, but they will no doubt put the burden of proof on you assuming you are just trying to get out of paying, I would practice shedding the proverbial tear...

Well i am hear to tell you that you really just cant change your cs without the court approve. even if she agrees with it. because if you have to send the payment to child support and then it goes to her. and the cs office has it where you have to pay her $850 a month. But what I recommend you to do is that get a job what ever job you can get and then go back to court and then they will make you pay out of what you can give off what you make out of your new job.

Ok keep in mind the little girl is with her full time! Stop concentrating on her income because she could've been a (sob) and left it the way it is! Keep looking for a job and pay the 550 because think of daycare expense, roof over there heads, clothes and trust me she growing like a weed! And everything else! Sounds like the childs mother is a beautiful person to try to at least consider helping you by dropping a portion of the cs!!!!!!!!!!!!!!! Sorry honey but that's just me being honest!

Yeah, go to child support and ask for a revision based on your new income. With 50% custody you may end up getting support from her.

Personally though, if you both share custody I don't understand why you are paying anything. But if that is how she is then I would get the revision, or possibly a lawyer and have the tables turned to make it fair for you.

You can take a chance back in court to have your child support remodified but usully the courts are more willing to raise it than lowering it, but you have nothing to lose here so try it. Just be prepared. When the courts award support then dont care how much of a financial burden it places or where it comes from as long as it is paid monthly. Good luck
