I recently was let go from a part-time, seasonal, sales associate posistion at Hallmark. Three weeks after working there, they said, I looked like I didnt want to be there, that my heart wasnt in the job. I told them they were wrong, that I did like working there because of the atmosphere. One manager said I had an attitude problem, yet I have never worked with her because she works mornings and I work evenings. The other manager didnt think I had an attitude and she should know since I have worked with her, although she claims I never approach the customers. I reminded them I sold 6 Precious Moments figurines on my first day and I knew where every card was when they were testing me during training, something they claimed hasnt happened for a long time. But they still let me go and decided to keep two girls who to this day still ask questions on how to do everything. Now, the only people working there are females. I get the feeling I was fired for being a guy...am I wrong?

Contact the labor board they can advise you if you can file a discrimination claim. And while you're at it, look on google for a lawyer that deals with this sort of law in your area.

I'd contact HallMark head office too.

No...strange as this may seem the reason you were fired was the reason they gave.....your heart wasn't in the job and that you really appeared not to want to be there. That is the reason they will give...if they give a reason...to any new employer that may call them.

However with that said...you may be right. They let you go in part because you were a guy and they find dealing with female employees to be easier.

Now the trick is to prove your theory. Or...let it go and go find another job. Make sure you know the composition of the staffing before you take a new job...you don't have to ask your new employer.....just look around and see if you find an even mix of male and female.

You have a "colorable case." To get it evaluated, call your county bar association for referrals to lawyers certified in civil rights/sex discrimination in the workplace cases. These are cases covered by court-awarded fees, so there should be no out-of-pocket charges beyond a nominal (less than $50) consultation fee that is used to defray the cost of the referral program,

First of all, think it through before you take any action and think about if it's really worth it to fight this over a job where you haven't even been six months...

Other than that... these people already seem "fake" to me, so why would you even want to work there?

Find a new job and let it go...

You should check with the labor board. They need to cite specific examples of this supposed "bad attitude", besides a general "not approaching customers". Personally if I was at Hallmark and a clerk pestered me, I would leave without buying anything.

Yes, you were fired for being a guy. You should find a job where testosterone is accepted. Don't bother with the lawsuit, you were there for three weeks and they don't need a reason to let you go. Just stop trying to work in the hen house.

Maybe your gender had something to do with it, but on the facts you state here, you would not have a successful discrimination claim.

You can't prove they fired you for being a guy and they gave you several logical reasons for their decision.

Attitude is in the eye of the beholder.

Honestly I doubt it or they would never have hired you if they had a problem with a guy working there. Maybe you just weren't as involved as they would have liked. Think very critically about your behavior as an employee there, were you really doing your best?

No one here can know if you were fired for being mail. There are only two options you have at this point:

1. file for unemployment and list the reason you believe you were terminated with UI, or;

2. file a complaint with your state EEOC.

My honest opinion is that you have no case.

Yes, seek out an employment lawyer. Get the Feds in on this case.
