no I think we are still allowed (well just) but it is not recommended. I agree with you though its a whole load of balls what they come up with just to penalise smokers. I mean how many accidents do we know have been caused by someone smoking in their car???
yeah you might cause accidents driving around naked though hehe

You are still allowed to smoke in your car but if you have an accident and it is related to "Careless driving" or "Driving without due care and attention" whilst lighting a cigarette you will be charged with one of the above offences..The same thing applies to eating whilst driving which has been around for years ...

As I believe they are not telling you you can't smoke in your car, just if you are not in control of the car whilst smoking you can be liable for a fine or punishment. I happen to agree with this, I also believe you shouldn't smoke if you have children in the car with you, but I think that should be a moral judgement, not a legally enforced one.

I agree that smokers are the most easily vilified segment of society at the present time.
There is even an apartment complex in CA where you can't smoke in your own home.
And the penalties on smokers (taxes mostly) appears to be a civil rights issue. How can they unnecessarily burden a legal habit?
And when cigarettes cost 12.00 a pack, and smokers are eventually forced to quit for economical reason, how in the world are states going to pave their roads.
More and more data is leaning toward obesity being an even greater health risk than smoking, but you don't see anyone placing an additional tax on Big Macs.
Those who applaud the "second class citizen" status that has been assigned to smokers.....better watch your fries and lattes....as is proven in today's news.....you are next.

These non smokers finally have done there last dash, I think it's time all of us smokers all now fought back for our rights. I get annoyed still by the fake coughs when you respect these idiots by not smoking around them and they still complain. Many pubs and clubs are closing down since they placed the non smoking rules and a lot of people already have lost there jobs over this smoking ban. Here in Australia these clowns now want to ban all smoking outside of bars and clubs also the open areas the bars and clubs spent thousands of dollars to build so you still can enjoy having a drink and a smoke at a bar trying to push us further out the doors.

In the UK, this has been added to the highway code. It can be seen as driving without due care and attention if you are smoking whilst driving.

If the smoke stayed where the smoker was it wouldn't be a problem but it drifts to where others are. You can smoke in your car. Unless ther is a child in it. You have no right to endanger a child's health.

It's only advisory,but if i was a policeman and saw someone smoking and driving with their kids in the car i would nick them and confiscate the car.

fred, where do you live that it's illegal to smoke in your car? It's legal in New York, which was one of the first states to have smoke-free stores, businesses, and bars on a county-by-county basis.
Is there more to it, perhaps? Maybe you can't smoke in your car if there are kids with you? Good law.
