Someone who I know phished my e-mail account, and stole pictures of me of a semi-pornographic fashion that I sent to my man in Iraq... she has then posted them on myspace, in MY NAME saying that I am looking for a man who is big and such, and I don't know what to do. I contacted myspace about it and have yet to hear from them. I'm desperate for answers. Local PD and the PD in her state have no law on it... so there is nothing they can do either. Someone point me in the right direction on how to correct this awful situation!

I contacted myspace, and explained everything that happened via e-mail. I have yet to hear anything about it as of yet. I sent the person who is doing it a message asking her to take it down and to stop impersonating me, and have yet to hear a response from her. *sigh*

I think you've got grounds to sue. Contact a lawyer.

If you can prove she did it, you can sue her. You would need a good attorney willing to take the case. This is just like the stolen celebrity sex tapes......but you aren't a celebrity and the damages are not the same so don't be disappointed if no lawyers take your case.

Bottom line, there really isn't much you can do. Maybe make friends with her again and get her to give them back.

claim that as the artist that you have Copyright to the images and their distribution is a violation of your rights as the artist to distribute them.

check myspace's Terms of service for a DMCA agent address.

Under the DMCA provisions it is necessary that the complaining party identify themselves. The complaintant need not be the owner of the copyrighted material but must have the owner's authorization, so the next thing you will need is the name and address of the person who is authorized to make the DMCA complaint. If you are the owner then naturally you are authorized, but you do not have to be an attorney.

Myspace will probably take them down as a result, if not send them to HACKER also, then sue everybody. (step 3: profit)

Sounds like a deformation of character lawsuite. You can sue on the grounds that she intentionally saught to harm your character. Also we have the issue of identity theft a new crime but one that should recieve serious interest and attention from the lawyers and courts. I say call a lawyer and sue her for all she has, which is probably nothing.

Sue for emotional distress and defamation of character. Get proof and go to court.
