does anybody know how an employee would be penalised with if they are caught discriminating or harassing another staff member.

At my company employees are given a verbal warning, then written up, then terminated. However, each manager handles each situation differently based on the specifics while keeping the company's liability in mind.

A woman distributed a racist email at the office and was written up and sent to sensitivity training. Even I could see that she didn't get the how inappropriate the email was; she's completely clueless. I think if she had a history of this stuff, she would have been fired.
