I used to work for the department of corrections, so I actually know the answer... at least for Illinois. The first thing that happens once you're in custody of the department of corrections, is they go to a classification prison, where they are classified as being male, female, affiliated with any particular gangs, needing special medical attention, what kind of a security threat are they, etc. If a hermaphrodite comes into the system, they will be classified as a male, and placed in a special wing, block, or building for vulnerable inmates.
