The United States Constitution does not specify the size of the Supreme Court; instead, Congress has the power to fix the number of Justices.

Look at FDRs attempt to 'pack the court'.

It is fixed by law. There are nine members, including the Chief Justice. Franklin Roosevelt tried to "pack" the Court
during his administration, but failed, thank goodness.
