Can anyone help me? We had to pull our children out of daycare. Our daycare provider was not happy, and before we left on the last day, she promised to mail us her SSN for tax purposes and $40 for a high chair that we bought and she broke. We waited a couple of weeks, never got anything from her. When I finally called her number her sister answered and said she moved to another state and didn't have her cell phone number, which, as close as they are I don't buy it. We paid her almost $5000 to watch our kids, and we want to be able to claim that on our taxes, but without her SSN, we can't, and it's basically like we paid her under the table, which we had absolutely NO intention of doing. We're in CA, if that helps. Is this fraud? I KNOW her sister knows how to get a hold of her, she is just unwilling to help. Should I go to the police? A lawyer? Anyone ever had anything like this happen to them?

For Crystal, wow. Seriously? I didn't realize that I had asked why employers require ssn BEFORE employment. If I had, then your answer would have been helpful. But since I didn't, you're a dumbass. Don't answer questions just for points, that's stupid.

And, we loved her and planned to use her forever, so thats why we didn't worry about her ssn. Us firing her was a fast decision, we didn't have time to get it and we trusted that she would mail it to us. I'm not looking for "it's your own fault", i'm looking for what can i do now. Come on ppl, we ALL know hindsight is 20/20.

call your local health department and ask for the child care licensing surveyor. Explain the situation to them and ask if they have any information that would be helpful to you. When I applied for my daycare license I had to give this information to them and they might be able to help you or point you in the right direction.

Take a deep breath and think rationally!

If you know you needed the SSN, then you should have gotten if FIRST. If anything the fault is yours. She is not responsible for your taxes.

I don't think you need a lawyer, I am sure this is a routine matter for a CPA.

Of course, we can probably guess why she is reluctant to give you a SSN, and then if you employed her without the proper info it WAS under the table, and your CPA will tell you if you need a lawyer for that. Probably not.

There is no fraud here, only you failing to execute your responsibilities as an employer, OK it was procrastination, but still...

Let her go and worry about yourself.

This is why you are supposed to get the SSN BEFORE you pay the FIRST dime.You DID pay her under the table. Unless you withheld and remitted Social Security taxes, which you CAN'T do without her SSN, she was paid 'under the table'. You are as guilty as she is.

This is why employers are required to verify social security numbers at the beginning of an employment relationship, when you hire someone.

Call the police and have them send a patrolman to her sister's house. You'll be surprised how fast she turns up!
