I was laid off and they are hiring more people and I was never given the chance for a call back. I was never late, never left early and never missed. Isnt there something I could do? I am in Ohio.

they probably laid you off for your quality of work. the law specifies that call backs aren't neccessary. But it's become common sense to do it.

How many people were laid off when you were? How long has it been since you were laid off?

I agree with Mary - unless you belong to a union and/or have some type of collective bargaining agreement, there are usually no rights to a call-back (or if you work for a government agency, you may have some without these).

Unless you belong to a union or under a specific type of labor contract, then you were most likely not laid off but fired, and they just called it a layoff.

It's a very common thing for companies to do. They just "fire" several people in the same day and call it a layoff.

If your layoff was presented as a "temporary" layoff, you may have callback rights. Most layoffs these days are presented as a "permanent" layoff, meaning that you have no rights beyond those of any other applicant. You can reapply and be considered for the position again, but the company is under no obligation to rehire you.

Unfortanately, it is not against the law, unless they stipulated to you in your packet that you would be hired back on. The reason they hire new people might be because they get to hire more un-experienced employees at a lower salary.

No, it isn't against the law. Your only recourse would be if you had some sort of contract requiring them to call you back before hiring new people.
