What is the issue? A group of people beat up one person and people are upset they are getting charged? Are people only upset because it was black against white? What if the six kids where white beating up one back? What if they were all white, what if they were all black?

I can remember things like this happening in my highschool but not having to do with race. This group of people is terrioizing that group because they skateboard and they hate anyone who plays sports. If there were ever a fight where it were 6 on 1 you better believe they were going to have charges pressed, regardless of their backround or the color of their skin. Can someone help me understand this?

People were outraged because of the attempted murder charges put on them, a possible 20+ year sentence. Like I told the other person who said the six should be given at least seven years in prison:

Based on the charges, NO. Even assault with intent to do great bodily harm can be as little as six months. Only when guns, knives, vehicles or serious bodily injuries that require significant rehabilitation are involved do the sentences extend past two years, in the large majority of instances.

He stomped his victim in the face, head and stomach repeatedly AFTER the victim was unconscious. That is "Sadism" and higher sentencing guidelines are placed on that sort of attack.

In this case, http://courtofappeals.mijud.net/DOCUMENTS/OPINIONS/FINAL/COA/20050308_C250804_46_26O.250804.OPN.COA.PDF the attacker was a habitual offender of prior domestic related felonies including felonious assualt, assault with intent to commit murder and others. His sentence was 10 to 30 years. If you read the case, you'll see the brutal attack he imposed on his wife where she was left in a wheelchair for weeks after.

The Jena victim was able to go to a school function the next day. I'm sorry, the SAME day.

I could go on but you get the picture.

Bottom line is under the circumstances and since the boy attended a school function, I would even say it was a basic assault and battery. Beating a person with a shoe (Mychal Bell) would not constitute GBH. Now, if Bell was kicking the victim repeatedly in the head area with brute force, that would be another issue.

I'm basing this off Michigan law. I have not seen a precedent where this sort of fight resulted in a prison sentence as you suggest.

From everything I've read thus far, I can't comprehend how anyone can defend a 6-on-1 beating, regardless of race. If it takes 5 other guys for you to get the guts to beat up one guy, you & those other 5 guys are nothing but a pack of cowards, which is exactly what these 6 kids are. If any of them had any guts whatsoever, they would have kept the fight 1-on-1. However, I also can't believe someone would think that some kids hanging nooses in a tree, no matter how insulting they may have found that action, would warrant ganging up on 1 kid & beating him. Where's the logic in that? Sounds like some kindergarten garbage: they insulted me & made me cry, so my buddies & I beat them up for it. Besides, where I live, there will probably soon be nooses hanging from trees all over the place... as Halloween decorations. Does this mean the people who decorate their trees with nooses or bodies hanging in effigy for this holiday should be beaten up by gangs of cowardly thugs? I think not. Get some prespective, people! If it takes 6 to beat up 1, perhaps attempted murder charges are warranted. It might keep idiots from doing stuff like this in the future.

There were two seperate incidents that started all of this.
There is a tree on that school campus, and some white students got mad and beat up some black students, saying that only white people can sit under that tree. The white students were not charged with anything, not suspended from school, nothing.
this caused more problems. It escalated to a point where 6 black kids got into a fight with some white kids. Those 6 black kids were charged as criminal adults, and put in jail.
Both groups of kids were wrong in how they handled things, but the white kids were not held accountable for their actions in any way, shape or form. The black kids had the book thrown at them, for very similar actions. There shouldn't be a double standard. Both groups should have faced suspensions or jail.Both groups were wrong, but they did almost identical things, and were treated VERY differently. That is where the problem lies. This is a racially based issue. HUGE issue.

Then you are a highly intelligent person. That IS exactly the issue but because there is no law against hanging nooses in a tree, despite the cultural and historical implications, the White kids were suspended not charged with a crime. Therefore, far too many Blacks think this is racism since they believe that the 6 Blacks who assaulted 1 White kid to unconsciousness and then kept on kicking him until they were pulled off of him are being treated too harshly for their assault. You understand totally correctly!

eThe Jena 6 started with what has been a long standing RACIST issue called the "white tree". Only white people were allowed to sit under this tree, and when some black students tried to break that barrier problems arose. NOW LISTEN YOU PITY RACISTS (in other words people that are about to call me a racist), I do NOT condone or promote this. The next day there were hang men nooses that were hanging from that tree as a warning to all black students NOT to hang around that tree. This prompted the 6 black students to beating senseless that one white student. And from different news sources that I heard the beating lasted for 45 minutes (my opinion, either those 6 black students can't fight AND/OR that one white student defended himself pretty good).

If those 6 black students are brought to trial for attempted murder of that white student, then they need to find the white students that hung the nooses and charge them with hate crimes and terrorism. If you look at the definition of terrorism then you will see that it is one group that uses terror like means to enforce their ideas and beliefs. Whether it is Al Quida in the middle east OR the KKK in the Southeast US, or Black Panthers in Los Angels

Hi. This situation is about the fighting but, besides that fact that it was black against white. This is about the system and how it mistreats the young black male when he becomes involved in a not so good situation. The main black kid is being charged as an adult and that's not right. He was involved in a fight (which is wrong) but, like you said it's something that 's been happening forever.
The judge gave him a ridiculous bond and the whole thing is just crazy.
Life is Life. Can't We all just Get Along For Peace Sakes!!!!!

i dont get it either!!! all i know is if it were 6 white kids beating up 1 black kid, all 6 white boys would be sitting in prison !!!!
