My ex husband filed a motion to stop paying child support. He lives in another state. I didn't make it to the court that day and on our Child support enforcement page it just says the court action was dismissed. Does that mean the child support order that is in place was dismissed or was his request to terminate the child support dismissed????

thank you

Motions should be either granted or denied, not dismissed. If a hearing was being held on the day you did not show up, you need to determine EXACTLY what was being heard that day. In Delaware, motions don't have hearings -- they are decided by a hearing officer without a one. Only PETITIONS for support, arrears, modification are actually heard.

If the hearing that day was on YOUR petition for initial child support, and it was dismissed, your child support may be stopped. If it was on a modification or arrears hearing, the orginal order stays in place with no change. If it was (for some reason) HIS motion being heard, then HIS MOTION is dismissed and the support order stays in place.

You will need to call Child Support Enforcement. It sounds like they are not going to continue with your child support needs since you didn't show up for court. When it comes to Child support and court you have to make an appearance. That is a must. Call immediately.

I think it means that the request to terminate was dismissed.
