Are there any sites, paperwork that can be filled out to take to the banks with out ending up in court? Any legal advice would be much appreciated.

It is not possible to avoid probate. This is one law that is carved in stone. Even with an attorney, you still have to go through probate and the attorney cannot change the outcome of the probate.
I've been through this process twice.

If you are asking how to gain access to accounts in your father's name and no one else's without probate....

you can't.

Unless these accounts are in joint names...nope.

If there is a will you must apply to probate it.

If there is no will you must apply to administer the estate.

Sorry, no way around it.

No. Unless your father has no assets, you can't avoid probate.
