Hi. Me and my wife divorced in Nov, 2004. Divorce decree stated half of 401K will be hers, but No QDRO was completed. Can she still come after me, or is it too late now?

Yes she can still come after you. And heaven forbid you actually cash out instead of rolling over that balance. Depends on how the divorce decree is worded this could get ugly. A QDRO is not that expensive to get, I'd file one with the court now just to get the account split and get her out of your life.

by the way...this is not state law it's federal law that governs this.

I wish I can help you with the Texas law, but here in New York State, if you are married to your first wife for 11 years and you die she gets your 401K and S.S and more.

I live in IL. getting a divorce too, if it's not written in the divorce papers, I would think she's S.O.L. BUT...check with your lawyer just to make sure.
