hello to all. ok i work for this benefit administrating company, in the bay area, my boss has been such a unprofessional supervisor for the last 2 months he has been calling me things i don't appreciate like blind, slow, dumb and so on. i have spoke with HR but they tell me he is going to be himself. what can i do to protect my rights as a employee? please help, he has even called me dumb in front of a printer technician who does not work for the company, he has called other people dumb and dumber, and i don't like that. i don't have that much money for a lawyer what can i do to make him pay for what he has done to my self-esteem. thank you

I believe the equal employment opportunity commission handles discrimination in the work place. You don't need to be a minority to seek redress. They are federal and can give free advise and maybe take action for you. If they feel you are justified you would file a complaint with them. Document dates and times and exactly what was said. No one should be treated like that!

I'm sorry other people are so incentive. The boss is wrong and does not have a right to be abusive. He may actually want to fire you but hope you will quit first because that is easier.

You can check to see what the requirements are for unemployment. In my state, if an employee can prove that there was an inappropriate or illegal environment, and that despite his/her attempts to remedy the issue by bringing it to management's attention, the issue remains . . . he/she can quit and collect unemployment.

You could see an attorney who charges on a contingency fee basis (which means s/he'd get a portion of whatever you won). In that case, you may well have a claim against the supervisor (and against the company) for "intentional infliction of emotional distress."

If you're really upset, I'd keep a log of what is said/done. If you alert management, I'd do it in writing -- so that you have a way to verify that it was done (you could even ask them to sign it saying the got a copy, then copy it for yourself).

This type of documentation would support you either way (unemployment or a lawsuit).

You could potentiality even record him making statements to you . . . .

If you feel that your self-esteem has been damaged because of this, you should see a mental health professional (if you decide to go to court over this, the health professionals evaluation, diagnosis, and treatment can be used in court -- and the costs of the treatment can be added to the damages awarded to you. . . in addition to court costs, and stuff like that).

kick his ***, and then tell him to go screw himself, but only after you find a new job.

I was kidding about the first paart, but you could just do something to his car or something like that when he isn't around. I 'm again kidding.

Talk to him and see what he says, tell him he is being unprofessional, or talk to the HR people and mention a suit I bet they will act them if they hear that. I don't think you should sue not for that, they are right everyone sues for no reason, but you shouldn't let him get away with it either.

I'm saying just say something don't be confrontational and don't really kick his ***, or do anything violent.

Every whiny little baby wants to sue these day, be an adult and suck it up. "But....he hurt my self esteem" Get real, grow up.

Maybe your boss is right, I mean you don't even know how to spell lawsuit.
