No.

Love should not die, and marriage was based on the concept that love never dies, and committing to a love is not wrong, it is just exclusive, meaning it takes precedence in your heart over all other loves. It does not mean you should have to give up your other loves. It just means you should not view them with the same zeal as you see that particular love.

I think these people have love. I just don't think they can share that love with more than one person at a time.

Do they have to have it that way?

No.

But if they don't where does it end?

Where does their open relationship lead them?

How will they know when the person they are with is someone they should not be with?

Plato discussed this in "The Republic" when he suggested a form of free love that allow you to love who you wanted but the children ended up in the hands of government. The thought was that they would keep you from sleeping with your own children, but we all know how reliable governments are. So the chance is there in a world without marriage that you might end up sleeping with your children or close relatives.

I know this is the extreme but that is where I think this idea comes from the extreme of what could go wrong.

Not to mention they used to kill you if they wanted your mate.

It doesn't happen that much any more but it could.

But No, they have love, they just chose to make it exclusive.

I would make a minor adjustment and say that ..

because of those without love, it must be made into a law.

No, personally I think life without rules is chaos. It permeates all of our lives and every inch of our character. I mean we judge one another's character on how they react to the written and unwritten laws of the land. Is she moral, is he honest, are they trustworthy? Where do these terms come from if not from some rules and regulations? No, personally I don't think love and chaos can co-habitate.

I assume you are talking about marriage. i think some people just want society to know they are bound to one another. It does not mean there is no love.
