I was pull over in a "speed trap" pass a down wered hill In San Diego, This Motor COP from Traffic Division said I was going 48 mph in a 30mph zone, however he wrote it as 40mph on my ticket and spelled my middle name wrong.

Should I fight This Traffic "Infraction" or go to a California Traffic School,

I am a criminal Justice major in college and i feel I was wrongfully cited in a low-income neighborhood where this cop only used radar gun to justify his citation.

What are your opinions and how should I fight this injustice for revenue!!

Well, often the police will tell you you were doing say 48 in a 35 and then "give you a break" by writing a citation for a lesser amount. This isn't a mistake on the ticket, it's a break. As for your middle name being wrong, you can try to fight it on a technicality, or hire a lawyer to fight the ticket, but hell, it's 10 over... You go in with the attitude that's in this post, and you'll probably walk out with the full fine, and a contempt of court charge.. I'd just pay the fine if you can, and not waste your time in court or traffic school and slow down in the future.

If the officer was using a radar gun, then it was not a speed trap. It appears, rather, that there was specific enforcement at this hill because there has been a problem with people speeding down it. The officer gave you a break by citing you far under the speed at which he clocked you, and saved you $120! (The scheduled fine for 1-15 over the limit is $146, for 16-25 its $266.)

I don't see what principle you want to fight for unless it is 1) police officers should not give speeders breaks; or 2) people should be able to speed; or 3) police officers should spell better.

Go to traffic school.

You didn't set forth a single relevant or admissible fact that would help you win your case. You didn't even deny that you were speeding. That fact that he wrote up at 40 instead of 38 to give you a break or wrote your middle name incorrectly will have absolutely no impact on the judge's decision.

Go to traffic school. Fighting a traffic ticket in San Diego is next to impossible.

When you go to court and see that the cop has shown up don't agree to a nonjudge. Don't sign this waiver. You will then be assigned to another court room for a real judge. When you appear in front of the new judge, and the cop is still there, exercise your rights under section 170.6 to dismiss this judge for any cause. You will then be assigned to another judge. If the cop is still hanging around just walk away. You will never win when the cop is in court but you at least gave it a try to eliminate him by a long court day.

Fight it. If the officer got the information wrong, then the ticket may be invalid. The only problem with fighting it is that the police department may make you a target. Proving harrassment is a whole different game. Good luck.

well i would just go to the traffic school, how hard could it be?
and if you fought it, it would be a waste of time..what would you get out of it? besides it would take money,time, patience and all that junk. do you really want to stress yourself out just for a lousy ticket. sorry to tell you but alot of cops are asses, thats something you got to deal with.. as for misspelling your name, well maybe he needs to go back to school and learn how to spell, or he should've asked you how to spell it. i dont like cops any way.. only a few are nice. well good luck!
