My husband pays child support (on time and in full). In his divorce decree he pays 1/2 of copayments, medicine, daycare, ect. but it says nothing about lunches. It does say that he has to pay for post secondary education but that is college. Does he have to pay for 1/2 of school lunches. He thinks not, but his ex says yes. I thought that child support covers food, shelter, and clothing the necessities. School lunch is food, a basic necessity so what do you think.

Child support covers the cost of living for a child, so yes, it may be used to cover school books and lunches. However, it is the responsibility of the parent that the child resides with to budget the support money.

I've never heard of a man being forced to pay for his children's lunches...I have on the other hand used child support to buy my children's lunches with.
Honestly I'm not trying to be mean but you are VERY lucky to have an ex that pays his child support on time and in full as you say.

Child support covers food, including school lunches.

I think the appropriate thing would be for the support to cover the school lunches... UNLESS his ex can prove that the cost of lunches are extraneous outside the capabilities of what she gets in support. The whole idea of splitting cost isn't to make things easier on the custodial parent, but to give the child everything they need. If they can have everything they need with the child support ordered, then.

School lunches are food. That is included in the child support he is paying you. My ex would flip out of I asked him to pay for half the children's school lunches on top of the money he's already paying every month.

If not actually stated in the decree , probably difficult to get . They base child support as a whole not as seperate indications . So in what they are paying in is already incorporated into the amount unless otherwise stated .

this has to be one of the most reduculous questions i've ever seen (YOU are NOT rediculous but the subject is).
Your friend is grasping at straws... child support is calculated based on the incomes of both parents... and the father pays in accordance to that calculation. It's the custodial parent's responsibility to pack or pay for a lunch.
If she doesn't feel she can afford it, there are lunch programs in schools and she can see if she is eligible for free or reduced price lunches.

I think part of his child support should go to paying their school lunches. The courts don't concern themselves with what child support is being used for.
