You mean if they are playing together, of course you can. First, if you are in your house, what is the issue. If you are outside, and they are outside, you can.

I am presuming this is just good clean fun.
I am also presuming that you are not talking about a fixed tape camera that records without the knowledge of the children. In that case you have some legal issues to address.

Bottom line is this. The kids are playing and you pull out the camcorder, they see it, no problem.

If anyone is outside where they can be seen by the public at large, you can video tape them as well.

Not really -- it depends on what you're using it for, and if the video will be shown publicly, etc. The cops won't come and break down your door if you record a kid without his parents' approval, but it might cause legal problems -- for them, not for you -- just the same. Just think about all the possible problems that could arise from a publicly-aired video of kids who are involved in custody disputes, for example.

If this is just, say, you videotaping your child's birthday party and other kids will be present, maybe you could mention that videos will be made on the invitation or something.

Just on its own, yes, that's legal. That's where you get videos of birthday parties, Christmas pageants and kindergarten graduations.

As long as it's not pornographic, or any other illegal activity, being violated, just having the video is legal for private use.

It is illegal to tape them (or photograph, etc.) and take it public, without the other parents' consent.

I don't know, but I think if the other parent specifically tells you they don't want their child videotaped, those wishes have to be respected, but I'm not even entirely sure about that.

Sure, especially if it is in public.

But one couldn't profit from it without a consent/release form.

That is why there is such legalese on anything you might send to "America's funniest home videos". You have to vouch that every identifiable person in the tape agrees to have it shown.

This is an established area of law, any filmmaker or news photographer needs to know the rules.

Personally, I think this is an area ripe for trouble on Youtube and other video sites...someone is going to make money and then someone else in the video is going to assert that they didin't sign a release, and then they are going to sue....

If they are in a public place, yes. There is no expectation of privacy in the street, in a public park, at a mall etc.

Depends on what your using it for. If your perv, and using it for illegal activities, then yeah its not legal, if your using it for TV, advertising etc.. then yeah,, its not legal either. But if your just wanting to video tape a family video then its fine.

your question makes me wonder if your a stalker or a pervert,,,,,as im sure other people feel the same ,, stay away from kids, you wanna tape somthing go to the zoo and film monkeys fuc-ing or somthing for your own personel home veiwing,

No. If they were in the vicinity of what was being taped, what is the crime?. If it bothers you, keep them away.
