My boyfriend works as a mechanic at a car dealorship, he makes 16.50 an hour but hes only coming home with 90 buck paychecks because he gets paid by the job, example: oil change in the books takes 2 hours my bf does it in 1 hes gets paid for those 2 hours, same with all jobs, but if theres no jobs he doesnt get paid, so he can go to work, no job come in and he gets no money, is this legal?

Yes legal, think it is time he looked for a new job, and in the back of my mind is always the thought is he really there all those hours? Sorry to even imply but something is not right here, and does not make sense, mechanics are in short supply and most places are busy as heck.

By law the minimum he can make is minimum wage. So is his weekly gross pay your state's minimum wage X the number of hours he worked? Does he punch in and off a time clock?

I'm going to be blunt.

Either you boyfriend is lying to you and not working all the hours he tells you he is.

Or, his boss is ripping him off and skirting the law (IF you bf is actually making at least minimum wage) and your boyfriend should contact the state labor board and file a formal complaint. Just make sure he documents all his hours and can give that to the labor board. And if this is the case your bf needs to start looking for work. ASAP.

An employer is required to pay minimum wage which is $5.85 per hour. If he is on the books and is working 40 hours at minimum wage his pay before taxes should be $284. He should contact the labor board. www.osha.gov.

It is called flat rate, it is quite leagl but not good if you are not experienced.

If he is an independent contractor, then, yes, it is legal.
