I have been taking care of a friend's little boy while she works for several months. Court paperwork dictates that she pay 48% and the father pay 52% of the childcare expenses. She has been paying me her portion plus part of the father's portion from the get go, as he has not ever paid a cent toward his childcare. I finally started giving him bills, and he has asked for my tax identification number, which I now know is my social security number.
I don't feel safe giving him my SSN, as he is not a trustworthy person, and I believe does things that are possibly illegal. Do I have to give him my SSN in order for him to claim childcare expenses on his taxes? Can he just give them my name and address? I already know I have to and will claim the income from this on my taxes. If I don't give him my SSN, does that mean he doesn't have to pay me for his child's childcare that I have provided?

Making money?! What I receive monetarily is FAR, FAR less than minimum wage!!! I'm not in this to make money, but I do have living expenses, also! If the father was paying me his portion, as well as the mother paying hers, I would be making about $3 an hour. As it is, it's about $1 an hour, and I provide food for the child.

Thank you to everyone for your input ~ I got a EIN# from the IRS, but found out that he doesn't qualify to claim childcare expenses on his taxes. The childcare isn't so he can work (he works at night), AND he's not the custodial parent (the parent with whom the child lived the greater part of the year). So I shouldn't have to give him my tax id # in order to recieve payment from him.

Yes, to show that he paid you, he'll need your ssn (I had to get my babysitter's to file taxes a few years ago)

BUT - if he isn't paying/hasn't paid, tell him simply that you can't provide him info to show that he has paid you if he hasn't, as that would be tax fraud. Tell him that once payment is made as it should be, you will give him the info.

In the meantime, go get a tax id number from the state - they're free, and easy to get. Just go to your local comptroller's office. Then you won't have to give your ssn to people for this.

If he isn't paying any portion of this, then don't give him your SSN, and stop billing him for unpaid childcare expenses. He can, and probably will, claim these as legitimate childcare expenses, so you need to be very careful here. If he does that, the IRS will come looking for your tax return & want to know where is the "money" he paid you. This is not a smart move on your part, so leave him alone. Your arrangements are with the child's mother, and if you don't get all that you feel you are due, either blow it off or find another way of making money.

No. You don't have to give him your SSN for any reason.
If he is claiming childcare expenses, that only involves him and his tax return.

I would not give him the number.

However, there is a small little trick if he is just crazy and driving you up the wall about this. Ok.... Go ahead and give him the number VERBALLY. Do not write it down!!!!! Let him do the writing.... preferably over the phone.

When you give it to him, "accidentally" make one of the numbers wrong. By the time (or if) he ever discovers this, it will be a long time and you can just say "I guess you made a mistake when you wrote it down"....

Check with a Federal Tax office. You should be able to file a 1099 (private contractor) form for your taxes and there is a form to give the Father also. If both the Mother and Father are paying you, make sure you properly state how much you get from each. I think they should each have a form from you.

I understand not wanting to give out that information. Actually a tax ID # is not a SS #. It's a separate # that businesses use. If you don't get one this situation may come up again. You can apply online:

I assume you and their dad aren't currently married. The parent they live with the greater amount of the year gets the child care credit or EIC, and the right to claim head of household, if they're eligible, no matter which parent claims them as a dependent..

Don't give him your SSN. Ask for a letter from his accountant specifying what he needs.

He may well need the child's SSN for his taxes.

Do not give him anything until you talk to someone, tax accountant, lawyer maybe. We here are not experts, and a phone call consultation if free.
