I soon realized after driving my car, that the chip has been removed, and a factory one put in its place. Im trying to figure out what is the best way to approach the dealer, without blowing up. There not allowed to change parts without stating it on the work order.

I have it confirmed by another tech that the chip is a factory one, and isnt chipped. The chipped one was quite obvious, with a big sticker across it. What to do/say?

Never under warranty. I paid cash for all my service.

Is it under warranty? Well no much say so, that can void your warranty. You lost it pal. Now, try to prove that you had that chip... now you are on a defensive mode.

Is all now a urine contest. The dealer I am pretty sure they are not going to give it back, neither buy one for you. Read the fine print on the invoice when the car went to the dealer before you jump on them. To prove it you need a prove of purchase and prove that was installed in the car. If they are nice to you, they could find it for you. But is a long shot, some of the Techs has it and will no fess on the crime.

Take them to court it will cost more than the chip itself.

I would take my losses and move on. Is gone... even if you throw a fit still is not an approved OEM part for that car.

Without solid proof, you have a situation where it is your word against the dealership's word/credibility.

If you have a receipt for the purchase and installation of your chip, along with a sworn statement of the tech who installed it, noting the date, time, etc., then you have a start.

You would then have to prove that the chip you installed was removed, and the factory chip put in its place, on the date you took your vehicle to that dealership. You then have the burden to prove that someone there actually removed your chip.

Obviously, the dealership won't admit to removing your chip. If it was removed, it was probably done by someone who works there, without the consent or knowledge of the service rep.

Was your car in for a drivability issue? There must be a reason why they had to look at your ecu. If it was a drivability issue then maybe they could not correct the problem with the aftermarket chip. Is your car under warranty? It wouldn`t be with a a/f chip. Talk to the service manager asap. You wait to long it may have gone out with the trash.

I took my car to the dealer for an oil change and they changed the ECU because the factory updated the programming.

It could be something like that. Just go back and ask for your chip.

If it's under warranty, and the ECU had failed and replaced for free you better don't mention it or you will get your old one back, and will be charged for repairs, AND your warranty would be void. If they did repairs at your expense without your concent - their *** is all yours... not a great asset if you ask me...

ken brings up good points but I think it's safe to say that some kid jacked your chip and by this time you're pretty much s.o.l.

Keep in mind, it might have been stolen by a mechanic who thought you might not notice.
