File a Motion to Continue. That's pretty much the only way. Find out if the other side objects; usually as a professional courtesy, they will not object to one continuance, unless you have known about the court date for a very long period of time, and are just trying to avoid the inevitable. It sounds like you don't have an attorney? If you can hire one, he/she will probably file for a continuance if the court date is close, as they won't have had time to prepare. The judge will grant or deny the request; and it is almost guaranteed to be granted if both parties agree to continue the hearing. Good Luck!

If I were you and I have done this many times, I would go in there alone (depending on the charge, murder I would have a lawyer present, traffic go alone) and just be honest to the judge and tell him your not prepared and would like a continuance. If this is your first one he will do it no questions asked. Before the trial he will announce to everyone the options you have, 1. plead guilty and get the fine/time he choses 2. Plead not guilty and have a date set in the future 3. Ask for a continuance and he will assign the next available court date. Hope this helps, honest works the best with judges, remember they've been doing this for a long time and have heard every excuse and dont want to hear yours.
