I don't know if they can really find out stuff like that, because where I'm from, employers can't find out your criminal charges, unless the would be employee obtains police clearance on his own.
So I don't see how employers finding out your educational institution would be any different. I'm sure schools don't release that info to just anybody who calls.
Usually by signing the application, you are providing your consent, and who knows what the employer is capable of finding out about you? They could have a friend or relative who happens to works at whatever university you list, and the info could be looked up as a favor, whether you give permission or not.

You're really asking if prospective employers may legally do a "background check" on you. The answer is yes because you've made the information public property by distributing a resume. They may now check everything you've listed, including education, references, previous jobs and they can do a criminal background check. What they CAN'T legally do is get your medical records. These are private in the US unless you give permission to dispense them. However, they can do drug tests, medical tests for TB and even fingerprint you before hiring you.

They can find out by calling the university and giving them your name and social security number which is also required to apply for a job. I don't think they can get copies of your transcripts, just that you attended, your major, and whether or not you graduated. Most companies require you to submit an official copy of your transcripts once they decide to hire you.

Enrollment and degree verifications can be done without your permission. Also, if you lie about that, and they find out at any time, they can fire you immediately, and you could be prosecuted for fraud.
They cannot get your transcripts without your permission, but if they really cared, they might request you send your transcript.
