You can get up to ten years in prison if found guilty if this goes to trial -otherwise you get a chance for 6 months house arrest, ('can leave the house for work and with your kids except for night time) probation, community service, anger management classes, sensitivity classes and the risk of deportation back to a violent poor third world Country. You have never done anything wrong before this in your life-'never even got a traffic ticket and even used to work in law enforcement.
Would you take the risk and go to trial and risk getting ten years in prison and being separated from your young kids and mentally handicapped child? Or accept a criminal record and risk of deportation with your kids and a bleak future? You really do not think you are guilty of a crime but the other person was badly injured and your injuries were minor in comparison. Please do not judge or be nasty-just advise me what you would do if this happened to you -ty.

The Lawyer is a new Law School Graduate with little experience and I've lived in Canada for over 20 years and have no family in the country I would be deported to -just because I neglected to get around to getting my citizenship years ago :-( My special needs son is Autistic and needs the services he can get here in Canada

The Crown is offering me a lesser charge of Assault causing bodily injury. (There were no weapons involved)

Self defense. You've done nothing wrong except for defending yourself. Play the card of poor 3rd world mother, handicapped child, never violated the law until now when *you* were attacked. You are the victim, not the ******** who hurt you. In my opinion you did absolutely the right thing in beating the living crap out of him. I would have done the same thing or worse -- killed him (I was raped before).
Use what you have: you're a woman, with small or under aged children, one handicapped, you're alone in this country with only your children who you're trying to provide for; you were attacked by a man who wanted to do you harm, you have nothing to look forward to but deportation or prison if found guilty (hey, play the sympathy card, his laywers will do so) YOU are the victim, NOT him!!

self defense all the way! maybe it would work 4 me being a girl, but i prefer self defense than aggravated assault as a stigma.

I'd want a trial. I'm sure my lawyer could find 12 suitable jurors..
