Back in freshman, soph, and junior year I havent doing good at all. I havent been able to do the homework (i been in accelerated and honors classes). My parents were worried and they have asked the counsler to have me tested for a learning disability. He at first was very against it, he told me that it would be an extremely long time and that it costs a lot of money and that they might not even take a look. He said that the agency would have to be informed but he wouldnt give the information, later when asked he said that if I try to get tested and if i am found with learning disabilities that I would get suspended and/or expelled (though he said that in private). Now my GPA is a low 1.2

Now I could have tried harder but considering I wasnt helped at all and that i was denied to be tested for a learning disabiity would I have a case?

To add this school is a very rich school whom do not have any special ed students or ones that they have put in "mentor programs" which basically they dont have to report their grades to the state.

You just need a few good excuses, you'll think of them without spending all that money

I would ignore the answer above me because its not an answer but someone who believes they are "elite". As towards your question its a tricky one. If you honestly believe you been wronged then I would speak with the principle of that school and then speak with a lawyer. Counslers can certainly be jerks and can be neglectful. I know for a fact that they are there to help all their students out and make sure no student fails. If he didn't do anything to help you out and when you attempted to get help he denied it to you then I think you can sue him for negligence. I am not sure what you can get out of the lawsuit maybe except for some cash and/or having your transcript altered. But you can certainly try. And ignore anyone who simply rants.

Stop blaming others for your troubles. You admitted you could have tried harder. If your parents were that worried, they could have taken you to a private counselor.
