I quit my job due to the fact that the director of my department was becoming increasingly hostile verbally, usually involving berating every decision I made, blaming me for things she did wrong, and inventing conversations that never actually took place. The final straw was when the director repeatedly referred to Mexicans as "thieves" (which I am half Mexican) and blacks as lazy. I spoke with her 3 times about this and having gotten no where went to the head of the company.

I explained the issue to the head of the company who told me he had no idea what to do, and referred to the state of the department as "sad" and was "worried about hiring additional employees under " the current director. after another couple weeks I decided that it was time to quit, I spoke with the head of the company again who offered to transfer me to a different department, I declined due to the my degree being in the field I was currently employed.

Unwilling to replace the director, I had to quit.

You quit. Sorry but unemployment is for people who are laid off. You should have taken the transfer, even if it wasn't in the field that you were trained for.

Even if you can prove what you said by e-mails or in writing, I don't think you have a case.

Your employer offered to move you to a different department, presumably away from the bad boss, and you declined. What else did you expect them to do? It is very difficult to fire a manager, especially if she has been with the company for a while and/or is doing a good job and/or her superiors are afraid of her! (hey, it happens!)

You should have put your energies into dealing with her and/or finding another job at a different company. I can appreciate your quitting, but you should have filed an official grievance with the State or Federal Equal Employment Opportunity Commission or Labor Board or similar; if you were unionized, you should have spoken with your Union head, as well. You didn't say that you did any of that, so, basically, you're up a creek.

Again, I appreciate where you're coming from - - I've walked out of jobs for far less reasons - - but you put yourself into this situation, and the State will probably find in favor of the employer, and deny you any unemployment.

The problem is the company offered you an alternative solution (placing you in a different department) and they have expressed concern over the current director, which would tell me that they were looking for cause to get rid of her. You should have filed a formal grievance with the personnel manager and accepted the alternate assignment and maintained your employment status ... who knows, they may have wanted to isolate you from the fall out in order to offer you the director position once they were able to get rid of the person currently in that position and you abandoned them.

I see a lot of answers noting that you do not have a chance but I think you do. If you decided to leave under unethical circumstances you can still file an EEO regardless of the time.

You will need to note that the untimely report is due to you not knowing is not a reason but since you left under unscrupulous practices may put you in the driver's seat. If you don't try it you will never know. Good luck some will take these cases Pro Bono.

Quitting means you voluntarily left. I don't think you have a chance.

You do not get unemployment when you quit a job. You are SOL.
