You can take them to small claims court if the amount is less than the limit for your local court. If the amount is more, you would need to file a law suit. In small claims court neither part is represented by a lawyer therefore making the process less expensive. You need to prove your case is "more-likely-than-not" based on what the court calls a preponderance of the evidence.
You will need to have something that shows the person owes you the money. This can be a contract or something as simple as an IOU.

So let's break this down:
1. You believe this person owes you money.
2. You need proof and preferrably written signed proof showing this person wrote or submitted something to you showing all that this person is in debt to you.

Yes. If you have evidence of the debt. Then you can get some relief in small claims court. The process is for you to file a form with the Marshal's office, or court clerk and have either the Marshal or yourself (even someone you trust) served the papers to whoever owes the money to you.
