Yes. I dated a guy that was charged and convicted of DUI because he was the legal owner of the vehicle, tested right at the legal limit, the keys were in the ignition and he was in a convenience store and his cousin has an open beer beside the car.
A relative was told by his attorney that as long as the keys are in the ignition, even if someone would be "sleeping it off" in the backseat" is the same as DUI because the intent was there that they would drive or had driven under the influence.

The last I heard, in California you could be charged with DUI if you are under the influence, have your car keys and appear to be heading for your car.
Like most laws, the DUI, DWI codes are on the books as state laws. They are fairly similar but if you check out the legal limits for BAC you will see they are in no way identical.
