David's right, but "costs" (filing fees, deposition transcripts, messenger fees, copying costs) are not the same as "fees" (which usually mean the attorney's charge to do work.

In America, losers of suits have to pay the other side's "costs" but, except in the case of particular types of suits governed by statute or by a contractual provision in which the parties agreed to fee-shifting, do NOT have to pay the other side's attorneys' fees.

The person that lost the case must also pay the other persons costs associated with going to court (lawyers, filing fees etc.)
