The story goes, they went on a Dutch Date at McDonald's and she wanted just a plain burger, nothing in it except meat, I guess. But instead, she got a regular burger, and the cooker was discusted, and spit on the burger in the back, and she happened to see this. We know this is a felony, is there any chance that they could bring this to court and get restitution? Because they just walked out with a free meal.

you can sue for anything you want to sue for... but have to make sure that you can prove with a preponderance of evidence (i.e. more than 50% certainty) that it happened... do you have any evidence?... otherwise it might turn into a "he said/she said" deal...

contact a local litigation specialist and see what they suggest... don't agree to any fees unless it is a percentage of the winnings (otherwise, you will end up paying a LOT more out of pocket with no promise of a return... then the cook gets the last laught)

Good luck getting a lawyer to take such a frivilous lawsuit case, and good luck finding a judge who doesn't throw it out of court. The best you could hope for is getting the burger flipper fired and a free meal Now if the guy had some disease who spat on it and she got sick and went to the hospital there might be something to it, then you could sue for damages you'd have hospital bills and such.

Do you really think that's the worst thing some cooker has done to a burger. I worked at a pizza delivery place. You don't even want to know what goes on there.

Yes, definitely you should. Let the management know about this and send an official complain to the headquarters of McDonalds stating the cooker's name and what time and day it happened. If you do not know his name, describe him. This is unbecoming of him. It would be good if you could prove it as well. Does the McDonald outlet has a camera?

It is a FELONY to spit on someone's burger? Wow, that is right up there with killing someone...Which I highly doubt..it is more likely a misdemeanor.

check out old news story about this cook who blew his nose in a COP'S burger!!! Judge found it repulsive, but not a felony.

Human fluids have a lot deceases in them so yes if she don't eat and saved it.. for testing (purpose other wise it hear say I'd contact manager first and try to have individual fired!!
aids is carried on spit, bodily fluids and deceases like colds.etc.

I would think that its her word against his, unless she saved the burger so they could test it for his dna or something. so unless hes willing to admitt that hes done that, theres really nothing that can be done.
