I am going to court in three days asking the judge to let me re-locate with my children, I am so nervous. I left my ex-husband one year ago because of his addiction to pain killers. He has since got fired from his job and got injured, so he collecting disability and takes oxy-contin, and just had his girlfriend arrested for domestic violence. I graduated from a trade school, got re- married and landed a great job where I will be living and I have my whole family around me. He lives in a city alone with no family and he wants to keep kids since he is home injured. I have offered to drive kids to see him and I only get 40 more days a year with them, but he said no, and now were going to court. What do you think the judge will do?

P.S. I have an attorney and hes representing himself. I have primary physical custody now.

I hate to worry you, but don't count your chickens before they hatch no matter what anyone says here. You really never can tell how these things will work out. It could go in your favor or not, just depends on the judge and the whole situation as the judge sees it.

Also, while I understand you have a great job offer I hope you are not blinding yourself to the importance of your kids having their dad in their lives. You may have your whole family in this new place, but your ex is your kid's family. Don't lose sight of that no matter what his problems are, he is still their dad. And it sounds like you don't have a problem with him seeing them, just this obstacle of a new job, etc.

Hope things work out in a way that makes your kids happy.

The judge is going to look at why... As for me, I found out from my lawyer (state of LA) that you can move for 2 reasons... First, to relocated back to where you came from. (We're military) Second is to move to where family is.

The judge is going to make sure this move isn't vindictive or hurtful to the other parent. If it is one or both, then the judge will allow it. Good luck and just check with your lawyer for your state.

I would not trust the ex with the kids, he's on drugs and is not fully aware of his surroundings, hard to say what the judge will do, but my guess with all this information on the table, no will be the answer.

The judge most likely will order full custody to you since you are more stable. He will still have visitation rights unless the judge knows he is doing illegal drugs but you have to have concrete proof. Good luck!

you are going to win. especially if he has no lawyer. if you left him because of an addiction to pain killers and he is still on them, that would be considered an unfit environment for a child.
