of her religion. If she says no to divorce after 5yrs have past then how do I get divorced. She says that she can contest it for years. I am not religious and so do not have to worry on theat score.

Your wife sounds like she does not know her religion very well...

In Catholicism it is taught that Marriage is permanent, and the only way to "end a marriage" is through a decree of nullity, which means that the marriage was never valid in the first place.

I'm Catholic...wait quick question were you married in church?

But if you are not religious this shouldn't bother you in the least...your ex not signing the divorce papers right away may delay the process if you try and get a (civil) divorce but church (nullity) is only if you'll be trying to get married through church again someday.

The Catholic Church believes that God does not recognize civil divorces.

Jesus said, "Therefore what God has joined together, no human being must separate." (Mark 10:9)

However there may be hope of a declaration of nullity.

The term "annulment" is a misnomer because the Church does not undo or erase a marriage bond.

Rather the Church issues a declaration of nullity when it discovers that the parties were not truly joined by God and hence a full spiritual sacramental marriage as understood by the Church was not present.

Then the parties are free to marry for the first time.

Approach the appropriate person your in your parish who has been trained in the process. If you encounter difficulties, you may go directly to the diocese.

Be prayerful, honest and patient. It takes a while.

If you are granted a declaration of nullity then there is no reason why she should object to a civil divorce.

Does she practice catholicism on a regular basis, were you married in the traditional sense? I'd go ahead and file for divorce you have a pretty good argument if she decides to contest and honestly, are you in a no fault state? Cause if so, you don't need a reason to file, and after so long they'll grant one, you'd have to call an attorney.

I think that she will not divorce you because (if this is still how it is) if she does then she can be ex-communicated which means she will be kicked out of the church. My mom was catholic and was married once before my dad and this man was very, very abusive in all areas. I'm not sure who initiated the divorce, but once it was final she was kicked out of the church. She was very upset about it. Maybe that is the reason she does not want to get a divorce....

Divorce is not a sin unless one intentionally causes a divorce.

Get an attorney. You have rights, and if she is refusing to be your wife, I'm certain the court would have something to say about it.

She doesn't have to GIVE you a divorce. The court will decide.

So let her contest it. She can't stop you only delay. But for both of your sakes think about counceling, marriage is a serious commitment. Also, start annulment proceedings, with her being catholic that is more of a threat than a divorce.

If you live in the United States, there is a separation between church and state. File your divorce with the state you live in and you will be granted your divorce... Don't worry.

She's just blowing smoke.

im assuming you are in ireland ? if in ireland you can only apply for a divorce once you've been separated for over 4 years. maybe shes holding on to the thought of you's getting back together and maybe once you's are that far apart she'l realise. if not seek legal advice, i highly doubt she can contest it especially considering te time and expense. good luck.

Well you can still contest it! get a lawyer and move on. I think thats cruel what shes doing to you.She can always get the marriage annulled, but im sure there is no law that will force you to stay married if you dont love her anymore.
