I have been approved to move into a privately owned building... the owner lives out of state... she told me to look over the apartment one more time before I signed the lease to see if there was anything I was concerned about. I met with the manager and she took me to look over the apartment. The carpet had been cleaned but the apartment had not been painted. Even though it wasn't really dirty I noticed some new spackle over a few places where the last tenant had lived there. I asked the manager whether the apartment would be painted before we moved in... of course she didn't know... She checked with the owner who apparently said she was not going to paint the apartment but I could tell her which parts of the aparment I want to have painted. I thought landlords have to paint an apartment between tenants for health reasons... Is she violating regulations... My husband really wants us to move into this apartment so I don't know how much to push this owner... What is your advice?

no i don't think they HAVE to, but i think you should talk to them about it. if it's in really bad condition they really should re-paint. or maybe they'd allow you to do it?

of course, if you're MY landlord, you'll paint all right---right over all the windows and electrical outlets. that was really sweet of him.

A landlord is not required to paint a unit for a new tenant. If you aren't satisfied with the place, just look for another apartment.

I doubt there are any regulations that say they MUST paint between tenants. If you agree to the current condition of the apartment, then they don't have to do anything (unless there are safety concerns)

Ask for the paint before you sign anything.

If you really want that apartment, ask for written permission to get it painted youself.

Check with zoning, but I've never seen a law that requires a fresh paint job before changing tenants. Ask her to paint it or refuse to rent; or paint it yourself and work out a deal with her

There are no requirements for the landlord to paint unless so specified in the rental agreement, however this could be a contention when you move out as it relates to your deposit. So to avoid you having to come back to yahoo answers in the future, (or come back and tell us that it worked out ok)make sure that you mention in the lease what rooms were needing painting when you moved in.

They don't have to paint, but you can work something out with your lease if you do. You can pay half of your rent for 2 months or a month or something like that. Mine let me do that.

|In general their is no law to require the landlord to repaint between rentals

On a side note I would document the move in condition of the unit, preferably with pictures so when you move out the landlord can not and try to charge you, saying the unit was in better condition then it was
