Sounds iffy to me. 5 days? She was not hurt? So what is she going to sue you for... hospital fees for a sore butt? Then there is the whole homeowners insurance contacting them. Normally you would be served in person or sent something that says you are being sued (by certified mail).

A court day would be established if it had any merit. Otherwise it would look like an attempt to just extract a settlement from the insurance company. The insurance company is not going to pay out without a serious investigation, court and whatnot. An attorney would know this. You would have to have a claim first and speak to your insurance company.

So it depends on your letter. If from the state/county it would state what they are sueing for. If from an attorney it would say as well. They can't sue you since you don't know when to show in court.

Call the attorney and find out what specifically you are being sued for. Call your insurance company and find out if you are covered but do not proceed further w. them. Talk to an attorney and then speak to you insurance company.

Sounds like a scam.

Who was the letter from?

And what did it say?

If the letter was from an attorney and simply said you are going to be sued, then I would wait. You might want to consult an attorney to give you advice on the matter though.

If the letter was from the court giving a date for a hearing, then you MUST appear for the hearing or you will lose by default. You really should consult an attorney if the letter was from the court.

Normally you will be served a summons in person (usually by a sheriff's deputy) if you are required to appear in court.

And, out of curiously, just how did these people who are suing you know your name, address, etc.???

was your dog on a leash? possibly some elaborate claim that your "vicious unleashed" dog attacked her? did the dog actually lick her? perhaps she picked up some dog-virus??

If they're claims really are without merit, do not give in, and do not settle out of court. There are lots of people out there that just make as many frivilous claims as they can, and hope to settle out of court for some quick easy cash. If there's enough on the line, hire a PI to do some back-ground research and see if they've made lots of claims like this.

Contact your insurance agent and file a claim under your renters/homeowners insurance.

Your insurance company will do an investigation. If they determine that you are not responsible for the girls alleged injury and the lawyer files a law suit - your insurance company will hire an attny to defend you.

The attny sent you the letter to prompt you to contact your insurance company.

i am not sure but that is very messed up. If she wanted to pet the dog without asking then she is doing it at her own risk. What is she saying is wrong with her?. Ok the worst could be she bumped her bottom..Big deal..People these days are greedy. Godd luck to you!
