Would've Jessep gone to jail?
Let's say he's not guilty for the code red (I do believe he's not guilty for it... anyway), would've he gone to jail for lying under oath and falsifying the transfer order.

Nathan Jessep is guilty of ordering the code red, according to the movie and is also guilty of covering it up. Would he have gone to jail? Probably not. He has friends in high places that agree with what he did. However, he would be forced to retire, probably get to keep his pensions etc.... At least, I believe that is what would have happened

Absolutely.

He is going to jail for all of it. The code red, he is the one who gave the order and he made it very clear that his orders are followed. He is also guilty of lying under oath and tampering with evidence for the tower log.

What is funny is I despise his character, but I really can not disagree with his speech he gives to Tom Cruise at the end of the movie. It is absolutely brilliant. The sad part is there are people just like him all over the government.

It would depend upon what the sentencing guidelines were for ordering a code red (which he admitted to, and which was in the official court martial transcript) that resulted in the death of a soldier.

He did go to jail, and we are lucky there are people like him in the military.
