The inside of the building as well as outside the building is nasty. Even in the winter the steps arent freed of snow until next day after asking since my daughter fell down the steps on the snow too.

I am a new teneant there and didnt really want to be known as the complainer so after a few times asking I just left it alone.

Was the building management on notice of a piece of plastic being on the stairs? Was the piece of plastic a hazard that you should have reasonable been able to see and avoid? How is it the building management's fault that you fell?

You know- sometimes crap happens.

Bupkes.

You would have to show that the defect--the piece of plastic--was put there by the landlord, or that it was there for so long that the super should have thrown it away. You're not going to be able to show that, so your case is essentially worthless.

Call a lawyer. You will have to sue the owner of the building's insurance company to try and recover damages.

I think you should ask your H.R. person to see what they can do for you.

It is good that you are in the U.S.. In other countries you would have had to wait months for a MRI.

You need to go to your employer's HR office and fill out either a short term or long term disability sheet.
