Or do you think that this peaceful protest was successful at forcing the justice system to be blind, and prosecute accordingly, with aggravated assault by a minor? Also, do you think the kids who were found today having hung four nooese on a truck would have been arrested? Or would that case have just been pushed aside like the many before it were?

justin, one was tried and convicted, which was overturned on appeal for being too harsh. You are wrong, he was tried and convicted.

sprcpt, the question is, do you think they would have reduced the charges on the others, if that conviction hadn't been overturned? No one else has been tried yet, so it was possible that the rest of them would have been charged the same. either way, does it nmake sense to charge someone inappropriately to begin with? why not put your racism aside and charge them correctly the first time? Why does it take a national incident to affect change? And no matter the answer, do you agree with our ability TO affect change using our protests? THOSE are my questions...please don't assume I am protecting bad behavior.

Had there been no protests nothing would have changed about the original situation...which would have been a real tragedy.
Peacful protesting to bring about change is always a good thing.

Peaceful protest has always made up the fabric of our country. I am a conservative and welcome those of good will who stand up for what is right not merely about whose cow is being gored. Anyone can be charged with anything at anytime as the Duke University charade has shown. The problem is you have radicals and racists on both sides out there who really don't care what the facts are. They bring a whole lot of baggage with them that has nothing to do with the problem. Even after the huge injustice at Duke was totally exposed, you still had folks out there who still wanted those boys hung, hung, hung. In this country now, totally overboard prosecutions for what ends up to be minor or nonexistent infractions nearly always draws the critical eye of the media and the public. Such scrutiny should be welcomed simply in the name of justice and fairness. As a former law enforcement officer with many years of experience, this is like a breath of fresh air. JUSTICE not prosecution should be the byword for anyone involved in the criminal JUSTICE system. Most of us on the beat and in the court system believe that. Now and then injustice slips thru the cracks. We all should be eternally vigilant. That is our right. That is our duty.

It is a sad day when a protest results in the blindfold being torn off of lady justice.
If justice was blind and served equally, they would still have been charged with attempted 2nd degree murder.
Only one of them was tried as an adult (because he had 4 previous violent felony convictions) and that conviction was thrown out and he will be re-tried as a juvenile.
His conviction was thrown out because an appeal said he should have been tried as a juvenile.
When racist people protest in defense of a racist criminal, it is a disgrace to all law abiding people.
The worst part of this case is the fact that if these were white kids they would have been thrown to the wolves with hate crime statues on top of the attempted murder charges.

Edit - Attempted murder was the appropriate charge.
When you beat someone past the point of unconsciousness and continue to beat and kick that person it is attempted 2nd degree murder.
It matters not that they weren't successfully in putting him in the hospital for months. If you shoot at someone and miss it is attempted murder too.
They tried to take that kids life!
It is not racism to charge people appropriately with attempted murder.
To have these kids face a lesser charge is a travesty.
To insist that charges be lowered because of someone elses racism is in itself racist.

Um, the crime happened 9 months ago, and the official charging happened several months ago. Nothing having to do with the actual charges was altered by the protests of a couple days ago. This whole thing is stupid. People are protesting against charges that were dropped/changed several months ago...

I believe if that people didn't bring public attention to this injustice then yeah they would have kept the attempted murder charges. My only question is how is this attempted murder? this kid was released from the hospital the same day and went to a school event that night he wasn't that hurt. Violence of any kind is wrong but to make it seem like these boys are violent murders is just as wrong.

I certainly do hope they would be charged the same! It was the crime they were charged with, not the protest!
Kids are stupid, all of them, no matter what color. Mine is 13 & he is as stupid as the next kid. It is what they are, they do stuff to cheese people off. It works doesn't it?? If people would just stop being offended by a symbol, none of this would happen!

First, it is not uncommon for a prosecutor to 'over charge' a defendant, then reduce the charges once he lawyers up, talks, or more evidence comes in. I feel that the charges would have been reduced anyway, but there is really no way to know. The way they beat that kid, I honestly wouldn't feel too bad if their charges were not reduced.
There is nothing illegal about hanging nooses. It may be offensive and in poor taste, but its technically not illegal.

No one has any way of knowing for sure. However I would like to add that I NEVER condone that type of behavior. Also, I am all for peaceful protest...that's how it should be done.
